Agreement for Travel Concierge and Tourism Services

These Terms and Conditions (“Terms”) govern the contractual relationship between MyTravCon LLC, a company registered in Dubai, United Arab Emirates, at [Placeholder Address, Dubai, UAE] (“MyTravCon,” “we,” “us,” or “our”) and you, the client (“you,” “Client,” or “your”), when you engage our travel concierge services for booking hotels, transfers, tours, flights, excursions, or other tourism-related services. By accessing www.mytravcon.com, contacting a concierge, or making a booking, you agree to be bound by these Terms, which apply to all services provided globally, including in the UAE, Western Europe, Asia, and the Americas, in accordance with UAE Federal Law No. 5 of 1985 (Civil Transactions Law) and applicable international regulations.

Acceptance of Terms
1.1. By engaging MyTravCon’s services, you confirm you are at least 18 years old, have legal capacity to enter this agreement, and accept these Terms in full. If booking on behalf of others (e.g., family or group), you warrant you have authority to bind them to these Terms.
1.2. These Terms constitute a legally binding agreement and supersede any prior agreements or understandings, whether written or oral, regarding MyTravCon’s services.
1.3. Failure to comply with these Terms may result in service termination, cancellation of bookings, or forfeiture of payments, as permitted by UAE law.
Scope of Services
2.1. MyTravCon acts as an intermediary, arranging tourism-related services, including but not limited to hotels, airport transfers, guided tours, flights, excursions, and related travel arrangements, through third-party suppliers (e.g., airlines, hotels, tour operators).
2.2. We do not directly provide transportation, accommodations, or other services but facilitate bookings based on your preferences, as communicated through www.mytravcon.com or your dedicated concierge.
2.3. Services are subject to availability and supplier terms, which will be provided to you digitally at the time of booking.
2.4. MyTravCon reserves the right to modify itineraries or services if necessary due to supplier constraints or unforeseen circumstances, with reasonable efforts to provide comparable alternatives.
Booking and Payment
3.1. Booking Process: Bookings are initiated via www.mytravcon.com or by contacting your concierge, requiring accurate personal and travel information (e.g., full names, passport details, travel dates, special requirements). Inaccurate or incomplete information may result in booking delays, cancellations, or additional costs.
3.2. Payment Methods: Payments are accepted via credit/debit cards (Visa, MasterCard, American Express), bank transfers, or digital payment platforms (e.g., PayPal, Apple Pay), processed securely through our online system. Cash payments are not accepted.
3.3. Payment Terms: A deposit (typically 20–50% of the total cost, as specified in the booking confirmation) is required to secure bookings. Full payment is due at least 30 days prior to travel, unless otherwise agreed. Late payments may result in booking cancellation without refund.
3.4. Pricing: Prices are quoted in UAE Dirham (AED) or your preferred currency, inclusive of applicable taxes but exclusive of supplier-imposed fees (e.g., resort fees, city taxes, baggage fees) unless explicitly stated. Prices are subject to change until booking confirmation due to supplier adjustments, currency fluctuations, or availability.
3.5. Trust Account: Payments may be held in an independent trust account until services are confirmed, in compliance with UAE Consumer Protection Law (Federal Decree-Law No. 5 of 2020).
Cancellations and Refunds
4.1. Client Cancellations: Cancellation requests must be submitted in writing via www.mytravcon.com or to your concierge. Refunds are subject to supplier policies, and non-refundable deposits or services will be disclosed at booking. Cancellation fees may apply, as outlined in the booking confirmation.
4.2. MyTravCon Cancellations: We may cancel bookings due to supplier unavailability, insolvency, or unforeseen circumstances (e.g., government restrictions). In such cases, we will offer alternative arrangements or refunds, subject to supplier terms and UAE law.
4.3. No-Show Policy: Failure to use booked services without prior notice (e.g., missing a flight or tour) will result in no refund, per supplier policies.
4.4. Refund Processing: Eligible refunds will be processed within 30 days to the original payment method, less any applicable fees or non-refundable amounts. Delays may occur due to supplier processing times.
4.5. Travel Disruptions: MyTravCon is not responsible for costs arising from travel disruptions (e.g., flight delays, itinerary changes) caused by suppliers or external factors. We will assist in coordinating alternatives where possible.
Client Responsibilities
5.1. Travel Documents: You are responsible for obtaining and maintaining valid passports, visas, vaccinations, and other entry requirements for your destination. Many countries require passports to be valid for six months beyond the return date. MyTravCon provides guidance but is not liable for entry denials, visa rejections, or document-related issues.
5.2. Compliance with Laws: You must comply with all applicable laws, regulations, and customs of the destinations visited, including UAE regulations, health protocols (e.g., COVID-19 measures), and local laws in Western Europe, Asia, or the Americas.
5.3. Supplier Terms: You agree to adhere to third-party supplier terms (e.g., airline baggage restrictions, hotel check-in policies), provided digitally by MyTravCon at booking.
5.4. Health and Safety: You are responsible for assessing your fitness to travel and complying with health and safety requirements. MyTravCon is not liable for health-related incidents during travel.
5.5. Accurate Information: You must provide accurate and complete information for bookings. MyTravCon is not responsible for losses or costs due to incorrect details provided by you.
Liability and Disclaimers
6.1. Third-Party Suppliers: MyTravCon acts solely as an agent for disclosed third-party suppliers and is not liable for their acts, omissions, or failures (e.g., flight cancellations, hotel service issues, tour disruptions). Any claims against suppliers must be directed to them, with MyTravCon’s assistance where possible.
6.2. Force Majeure: MyTravCon is not liable for disruptions caused by events beyond our control, including but not limited to natural disasters, political unrest, terrorism, pandemics, or labor disputes. We will endeavor to provide alternative arrangements where feasible.
6.3. Limitation of Liability: To the maximum extent permitted by UAE law (Federal Law No. 5 of 1985) and applicable regulations in Western Europe (e.g., EU Package Travel Directive 2015/2302), Asia, and the Americas, MyTravCon’s liability is limited to the cost of services booked through us. We disclaim liability for indirect, consequential, or incidental losses, including but not limited to lost profits, missed opportunities, or emotional distress.
6.4. Travel Risks: Travel inherently involves risks (e.g., injury, illness, property loss). You acknowledge and assume these risks, and MyTravCon is not liable for such incidents.
6.5. No Warranties: MyTravCon provides services on an “as-is” basis, with no warranties beyond those expressly stated in these Terms or required by UAE law.
Travel Insurance
7.1. MyTravCon strongly recommends purchasing comprehensive travel insurance to cover cancellations, medical emergencies, trip interruptions, and other risks.
7.2. We may offer insurance options through third-party providers, subject to separate terms and conditions. You are responsible for ensuring your insurance meets your needs.
7.3. MyTravCon is not liable for losses or costs that could have been covered by insurance, including supplier failures or travel disruptions.
Privacy and Data Protection
8.1. Data Collection: We collect personal information (e.g., name, contact details, passport information, payment details) to facilitate bookings and provide services, processed securely via our online platform at www.mytravcon.com.
8.2. Data Use: Your data is used for booking, communication, and compliance with legal obligations, in accordance with UAE Federal Decree-Law No. 45 of 2021 (Data Protection Law) and, for European clients, the General Data Protection Regulation (GDPR).
8.3. Data Sharing: We share necessary data with third-party suppliers (e.g., airlines, hotels) to fulfill bookings, ensuring compliance with applicable data protection laws.
8.4. Data Security: We employ industry-standard encryption and security measures to protect your data. However, you acknowledge the inherent risks of online data transmission.

Intellectual Property
9.1. All content on www.mytravcon.com, including text, logos, images, and itineraries, is the property of MyTravCon or its licensors and is protected by UAE and international copyright laws.
9.2. You may not reproduce, distribute, modify, or use our content for commercial purposes without prior written consent, except for personal use related to your travel bookings.
Dispute Resolution
10.1. Governing Law: These Terms are governed by the laws of the United Arab Emirates, with disputes subject to the exclusive jurisdiction of the courts of Dubai, unless local laws in Western Europe, Asia, or the Americas mandate alternative dispute resolution mechanisms for specific services.
10.2. Resolution Process: Any disputes or complaints must be submitted in writing via www.mytravcon.com within 30 days of the issue arising. We will attempt to resolve disputes amicably within 30 days.
10.3. Arbitration: Unresolved disputes may be referred to arbitration in Dubai, conducted in English under the rules of the Dubai International Arbitration Centre (DIAC), with the arbitrator’s decision being final and binding.
10.4. Consumer Rights: Clients in Western Europe may have additional protections under the EU Package Travel Directive (2015/2302). Clients in Asia and the Americas may have rights under local consumer protection laws, which MyTravCon will comply with as applicable.
Termination of Services
11.1. MyTravCon reserves the right to terminate or suspend services if you breach these Terms, fail to make timely payments, provide false information, or engage in conduct that disrupts our operations or supplier relationships.
11.2. Termination may result in cancellation of bookings and forfeiture of payments, subject to supplier policies and applicable law.
11.3. You may terminate your agreement with MyTravCon by providing written notice, subject to the cancellation policies outlined in Section 4.
Amendments to Terms
12.1. MyTravCon may amend these Terms at any time, with updates effective upon posting on www.mytravcon.com.
12.2. You are responsible for reviewing the latest Terms before booking. Continued use of our services constitutes acceptance of any amendments.
Force Majeure
13.1. MyTravCon is not liable for failure to perform obligations due to force majeure events, including but not limited to natural disasters, wars, terrorism, government restrictions, pandemics, or supplier insolvency.
13.2. In such cases, we will notify you promptly and offer reasonable alternatives or refunds, subject to supplier terms and applicable law.
Indemnity
14.1. You agree to indemnify and hold MyTravCon, its affiliates, and employees harmless from any claims, losses, damages, or liabilities (including legal fees) arising from your breach of these Terms, misuse of our services, or violation of third-party rights.
Miscellaneous
15.1. Severability: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15.2. No Waiver: Failure by MyTravCon to enforce any provision of these Terms does not constitute a waiver of that provision or any other rights.
15.3. Entire Agreement: These Terms, along with any booking confirmations and supplier terms provided, constitute the entire agreement between you and MyTravCon.
15.4. Language: These Terms are provided in English. Translations may be available for convenience, but the English version prevails in case of discrepancies.
